Service Agreement

This agreement describes the terms and conditions that apply to your participation in the Health Affiliates Network affiliate program as a publisher/affiliate. As used in this agreement, "we" or "us" refer to Health Affiliates Network, "you" or "your" refers to the participant or publisher. This is a legal agreement between you and Health Affiliates Network. By accepting the terms of this publisher agreement, you are stating that you have fully read and understood the terms set forth herein and are indicating your acceptance of this agreement and agree to be bound by its terms.

To begin : To begin the enrollment process, you will submit a complete Health Affiliates Network application to participate in our Affiliate Network. You will receive immediate conditional acceptance and an automatic response via email. We will then evaluate your application in good faith and verify the content of your website, if you have one.

We will notify you if your application is rejected. We may reject your application at any time if we determine that your site is unsuitable for the program for any reason. Violation includes, but is not limited to, your site including images or content that promotes obscene materials, child pornography, promotion of violence, promotion of discrimination based on race, sex, religion, nationality, disability, sexual orientation, age, promotion of illegal activities, or violation of intellectual property rights and/or copyrights or trademarks.

Information provided by you : It is importance that all publishers supply us with correct contact details including email and phone numbers at the time of sign-up. Without the correct contact details, we will not be in a position to process any commission payouts.

Order processing : Our online advertisers will be responsible for processing orders referred by you: credit card approval, prescription approval, shipment of the medication, cancellation and all customer service inquires (this includes contacting the customer over the phone or via email if necessary). They may decline an order due to medical reasons if suggested by our doctors, or if fraudulent information or location of delivery is stated by customers. We work with online health care and pharmaceutical advertisers, which does mean that some sales may not be approved on the basis of certain medical conditions. We work with online advertisers who delivers to almost every country except the US and Canada.

Commission : Affiliates can review the price-based list on our advertiser’s site.

You will be eligible for a sign up bonus of €50 as soon as your affiliate application is approved.

Commission will be calculated on the price of the product sold, only if the order is completely approved. Nevertheless you can earn €1 commission on every declined order, excluding test orders.

If you refer us an affiliate, you will be eligible for a referral bonus which is €10. The affiliate referral commission will be paid only after the referred affiliate makes his/her first approved sale and it will be paid only once.

Affiliates will be eligible for a 2-tier commission (€2) for every approved sale referred by their sub-affiliates. The multi-tier commission will be approved or paid as soon as the order is approved.

Pay outs : Commission payouts on sales generated through affiliate accounts will be paid bi-weekly on the condition the affiliate has earned the minimum threshold €50; however for the first payment the threshold amount will be €100.

Payouts will be credited directly to the affiliate’s account through the payment method selected by the affiliate. Affiliates should make the preference of their payment method clear at the time of sign-up.

If you have opted for the bank wire transfer method, a minimum balance of €250 is required in your account before you can receive any payment. Such transfers will only be made after the affiliate has submitted an invoice for sales generated. If the balance in your affiliate account is below €250, bank wire transfer charges of €30 will be applied for every payout requested/sent.

Tax responsibility : Tax responsibility rests with respective affiliates. Health Affiliates Network will under no condition be held responsible.

Qualifying products : All products listed in our advertiser’s website may be changed or new products may be added at any time. This includes any price changes according to market conditions or any price alteration given by a specific manufacture. Notifications will be sent via email.

Copyright and trademark material: Unless otherwise expressly indicated we are the sole and exclusive owners of all Intellectual Property Rights in our website including, but not limited to: all trademarks, code, text, sound, video, graphics, photographs and other images that form a part of the site. Affiliates are not permitted to use the copyright content (all trademarks, code, text, sound, video, graphics, photographs and other images that form a part of the site etc) of the Health Affiliates Network website. Furthermore, affiliates are not permitted to use the copyright content (all trademarks, code, text, sound, video, graphics, photographs and other images that form a part of the site etc) of our merchants, including but not limited to 121doc and Meds4all.

Affiliates should not create a website, which appears or looks similar to that of Health Affiliates Network website or the website of its merchants, including but not limited to, 121doc and Meds4all.

Affiliates are not permitted to register a domain with "Health Affiliates Network", "121doc" or "Meds4all" in their domain name nor are they permitted to create a sub-domain, which contains the keyword "Health Affiliates Network" "121doc" or "Meds4all".

Affiliates are not permitted to use the keywords "Health Affiliates Network", "121doc" or "Meds4all" anywhere in their PPC advertising.

Any Affiliate using or infringing our Intellectual Property together with the Intellectual Property of our merchants to promote their website without our express consent or of using a deceptively similar mark may at our sole discretion be removed from Health Affiliates Network and be subject to legal action.

Remedies And Waivers: No delay or omission in exercising any right, power or remedy provided by law or under this Agreement shall affect that right, power or remedy or operate as a waiver of it. The single or partial exercise of any right, power or remedy provided by law or under this Agreement shall not preclude any other or further exercise of it or the exercise of any other right, power or remedy.

Rights reserved: Health Affiliates Network reserves all rights to approve or decline affiliate applications anytime. No further communication will be done in the case of rejection of affiliate applications, once notified. Health Affiliates Network expects ethical business practice from its affiliates. Failure in doing so will make the affiliate eligible for termination of the affiliate’s commission. All pending commission will be cancelled in this case.
